Terms of Service – Domain Names

We may amend these terms of service with or without notice.

HostMaria provides domain name registration and management services as a reseller of RealtimeRegister B.V. and 20i Limited. By registering a domain name through HostMaria, you acknowledge and agree to comply with the following terms, as well as any applicable registrar and registry agreements.

1. Domain Registration and Use

  • We make reasonable efforts to register the domain name you request, but we do not guarantee availability or successful registration.
  • A domain name is considered registered when your details appear in the public WHOIS database as the registrant.
  • Domain names are registered for your use but remain the property of the respective registry. You acquire only usage rights, not ownership.
  • We reserve the right to reject, suspend, or cancel domain registrations if the requested name may violate laws, rights, or registrar/registry policies.
  • By registering a .LV domain name, you authorise HostMaria to enter into an agreement with the .LV registry (NIC, Institute of Mathematics and Computer Science, University of Latvia) on your behalf.

1a. UK Domain Name Registrations (.UK)

  • By registering a .UK domain name through HostMaria, you agree to be bound by Nominet's Terms and Conditions of Domain Name Registration and Rules of Registration.
  • You agree to provide and maintain accurate and up-to-date registrant information and understand that false or outdated data may result in suspension or cancellation.
  • You agree that your personal data may be used according to Nominet's Privacy Notice, and may be disclosed in WHOIS results where legally applicable.
  • You agree to be bound by Nominet’s Dispute Resolution Service (DRS).
  • Renewal reminders will be issued in advance of expiry, and registrants may renew at any point up to deletion.
  • Transfers out are permitted at no cost and must follow Nominet’s published procedures.
  • Domain names may be suspended or cancelled if used unlawfully, registered with false data, or in breach of any Nominet policy.

2. Registrar and Registry Agreements

3. Registrant Responsibilities

  • You must provide accurate and up-to-date contact information (including name, address, email, phone number, and authorized contact) and update it within 7 days of any change.
  • Providing false or outdated contact information may result in suspension or cancellation of your domain(s).
  • You must respond to inquiries about domain registration details within 15 days. Failure to do so may lead to loss of the domain.
  • If you license use of your domain to a third party, you remain the registrant of record and are responsible for any misuse or legal claims associated with the domain.
  • We may use public data sources (e.g., WHOIS lookups, company registries, DNS records) to verify the accuracy of your registration data.

4. Reseller Requirements (If Applicable)

  • As a reseller, you are required to:
    • Pass through all registrar and registry obligations to your clients;
    • Present and obtain acceptance of all relevant TLD, registrar, and registry terms;
    • Cooperate with all domain transfers and verification procedures;
    • Respond to abuse complaints within five business days and take corrective action.
  • RealtimeRegister may contact your clients directly only for compliance reasons, service announcements, or if you are unresponsive.

5. Uniform Domain-Name Dispute-Resolution Policy (UDRP)

All domain registrations are subject to the Uniform Domain-Name Dispute-Resolution Policy (UDRP) established by ICANN. This policy governs trademark-related disputes involving domain names. You agree to submit to any decision issued under the UDRP.

6. Abuse, Takedown & Verification

  • Domains may not be registered or used for illegal or abusive purposes, including:
    • Phishing, malware, botnets, or spam;
    • Distribution of defamatory, abusive, or hate speech content;
    • Trademark or copyright infringement;
    • Terrorism, fraud, or weapons/pharmaceutical sales in violation of local laws.
  • We follow Notice and Takedown procedures and reserve the right to suspend or cancel any domain if abuse or illegal activity is detected.
  • RealtimeRegister may invoice complaint-handling fees for excessive or unresolved abuse cases.

7. ICANN Data & Compliance (RAA 3.7.7)

  • ICANN requires all registrants to maintain accurate WHOIS data and acknowledge:
    • Use of Personal Data for registry and registrar operations;
    • Your right to access and correct data;
    • That Personal Data may be shared with registries and ICANN-accredited entities.
  • Registrants must:
    • Consent to ICANN’s data processing terms;
    • Indemnify the registry against claims related to domain registration and usage;
    • Submit to jurisdiction in their home country and where the registrar is located in case of disputes.
  • By registering a .LV domain, you also agree to the NIC.LV Privacy Policy:
  • For .LV domains, NIC.LV acts as the data controller. HostMaria acts as the data processor on behalf of the client.

8. Renewal, Deletion and Transfer

  • Domains are not automatically renewed. Renewal invoices are generated 7 days prior to the domain’s expiry date.
  • It is your responsibility to ensure payment is made before the renewal date. Unpaid renewal invoices will result in expiration and possible deletion of the domain name.
  • Domains will be considered terminated 30 days after the invoice due date if unpaid and not renewed.
  • HostMaria does not guarantee the restoration or recovery of expired domains. Recovery, if possible, may incur additional registry or registrar fees.
  • Transfers must be completed within five business days upon valid request and cannot be blocked due to unpaid invoices.

9. Termination

  • If your account is closed or suspended, all domain-related services will cease. Active domains may be transferred to another provider at your request.
  • Credit balances on termination are forfeited.
  • We reserve the right to suspend or terminate services without notice if you breach these terms, applicable registry or registrar policies, or engage in activities that threaten DNS or platform stability.

10. Data Retention

  • Client and domain registration data are retained for a minimum of six (6) years after termination of the service agreement, in accordance with applicable UK and EU regulations.
